Identify the owner
The City considers a tree private when more than half its trunk diameter at ground level is on the private side of the line. A tree planted on City property becomes a City tree even if a resident paid for it.
Use the City Tree Inventory or call 905-546-2489 for a Forestry Investigator where the City boundary is uncertain. Neighbour-to-neighbour boundaries depend on a survey; Building may hold a copy at 905-546-2424 extension 2720.
Private-tree rules differ by area
Private tree bylaws apply in Ancaster, Dundas and Stoney Creek and to woodlots. The former City of Hamilton does not currently have the same general private-tree bylaw, but that does not remove protected-land or other applicable requirements.
For permit uncertainty call 905-546-2782. A hired company doing pruning, removal or investigative work must hold a valid Hamilton Tree Cutting Service Licence. Private neighbour maintenance disputes are civil matters, not settled by the City.
City maintenance and removals
Urban City trees have a seven-year pruning cycle; rural City pruning is by request. Public tree work needs permission. The City removes trees it deems dead, diseased or dangerous, then handles the stump and any appropriate replacement.
Fruit, seeds, leaves and clogged eavestroughs are not accepted reasons on the removal list. Report damage, dead limbs, fallen trees or other concerns to 905-546-2489 for assessment and priority scheduling.
Utility lines and private debris
The City does not prune back from utility or communication lines; contact the utility. The source lists Alectra 1-833-253-2872, Hydro One 1-888-664-9376 and Bell 1-866-310-2355.
Private wood can use eligible yard-waste collection or a Community Recycling Centre, with a private company for pieces too large for collection. Verify size rules on the waste service page rather than assuming a whole trunk is eligible.
