Scope and exemptions
Bylaw 19-286 applies to excavating, depositing or stockpiling fill or topsoil, removing topsoil and altering grade. Complete the prescreening before applying.
Routine lawn or garden work can qualify only when fill depth is no more than 15 cm, neighbour drainage does not change and swales are not changed or blocked. Pool and issued-building-permit exceptions have separate conditions. If grading has not been certified closed, the source says a permit is required without exceptions.

Rural and planning checks
A one-time rural drainage/soil-quality exception allows up to 500 m³, imported only from within Hamilton, with at least 48 hours’ notice. Other rural pond or driveway exceptions preserve existing dimensions, grades and drainage.
Site Plan Approval may replace separate site-alteration review. An SPA exemption letter may be required if that process is waived. A Conservation Authority-regulated area needs consultation and correspondence. Do not assume a grading permit replaces those permissions.

Application, security and fees
Supply the application, checklist and professionally certified plans. A stamped cost estimate determines security of at least 50% of earthworks and 100% of restoration.
Listed fees are $1,155 residential minor, $3,540 non-residential major and $845 for a fourth or later submission. An order-related contravention application is double the ordinary fee. Exemption permits have no fee.

Timing, validity and contact
